INJUNCTION STOPS SALE OF HOTEL PROPERTY
- This is the status of the suit recently brought to sell the one half interest in the hotel property here. A year ago Steve
DEKAS and Louis T. GEORGETON purchased the Jeffersonville hotel property at Tazewell and since then have been conducting a hotel and restaurant here. Several thousand dollars have been expended by them in remodeling, refurnishing and improving the property. It seems that Louis T.
GEORGETON made advancements of money to his partner, Steve DEKAS, with which to help pay for the property and the new improvements and Steve
DEKAS executed a deed of trust on his one half undivided interest in the property to secure the payment of the advancements. Recently the trustee under the deed of trust was directed by Mr.
GEORGETON to make sale of one half interest of his partner in the hotel property and the sale was advertised to take place on the 17th inst. However, before the sale of the one half interest, Mr.
DEKAS brought suit against Mr. GEORGETON for a dissolution of the partnership, and asked that the court sell the hotel property as a whole, and wind up the partnership business, and also asked that
GEORGETON be enjoined from making sale under the deed of trust, as a sale of the undivided one half interest would result in a great sacrifice. Judge
KEGLEY granted a temporary injunction, stopping the sale, without passing on the merits of the case and referred the whole matter to the Circuit Court of Russell County for hearing and decision. Messrs. J.W.
HARMAN and J. Powell ROYALL, were counsel for DEKAS.
Mr. and Mrs. Roy ST. CLAIR have just closed the deal for the nice new home of Mr. and Mrs. B.W.
